
TERMS & CONDITIONS

Orders are placed on our calendar when the dessert service contract is signed and the 50% non-refundable deposit or full payment is received. Communication via email or via phone regarding the order are not considered as “holding the date” for your event. Once the deposit or payment is received, your order will be added to our calendar and preparation will begin. The retainer/payment reserves your event date/time and is non-refundable or transferable.​​​

If a last-minute order is accommodated, a $150.00 fee will be added to the invoice to accommodate and compensate us for the additional time spent to place your order into our schedule, creating a cake design, and ordering supplies.

Invoices will be canceled if not paid on the due date. Orders are not processed or considered until the deposit/full payment has been made. An automated email reminder will be sent on the due date if the invoice is not paid prior to the due date.

The balance of your payment must be received two weeks prior to your event. If payment is not received, the contract is null and void, your deposit will not be refunded, and your order will be canceled.

NO refunds will be issued under any circumstances, unless August June Desserts chooses to cancel your order. If that is to occur, you will receive a refund within 60 days of the cancellation.

Once the deposit/full payment has been paid, the invoice price remains fixed to the details listed. If changes to design or quantity are made, August June Desserts reserves the right to amend the invoice and re-submit with current pricing to the client. If an agreement on new pricing cannot be reached, normal cancellation terms will apply.

Order changes are only accepted from the client who has signed the contract. Order changes will not be accepted by outside parties whose name is not listed on the contract.

Any changes to the order (size, design, or flavor) must be made no later than fourteen (14) days prior to the event date. Any changes made less than 14 days prior to the event date cannot be guaranteed and will only be made at an additional based on current pricing.

All payments for shipped items must be received the Friday before the week the items are shipped. All baked goods are shipped on Wednesdays. You will receive a notification once the item has been shipped. For the health and safety of all, no returns are accepted. August June Desserts is not responsible for delayed, lost, or stolen packages. We have no control over any of the delivery systems other than what is reported to us via the tracking system of record. It is the customer's responsibility to file a claim with the United States Postal Service to receive compensation. Please read and follow the consumption guidelines provided with each shipped order.

All sales are final. Refund requests based on the flavor and the texture will not be honored. Every order is sent through quality testing before completion to ensure a satisfactory product. Clients requesting a refund after orders are delivered must return all uneaten portions of the product purchased for evaluation no later than the day after the event. If the product is deemed unsatisfactory upon our evaluation, a 25% credit will be allocated towards future purchases.

In the event that you fail to pay August June Desserts and collection procedures are initiated, you will be responsible for August June Desserts' reasonable attorney's fees and costs, including on any appeal. Venue for any such action shall be in Charlotte, North Carolina.

We design custom cakes with generic themes (race cars, mermaid, sports, etc.) or August June Desserts original designs. We do not design cakes with copyrighted characters, images, or designer logos (Mickey Mouse, Paw Patrol, Chanel), or cakes that reference drugs, guns, adult themes, and have have visible alcohol bottles. We do not offer burn cakes or alcohol dispenser cakes. If requested, we will bake alcohol infused cakes/cupcakes.

Our cake designs are inspired by photos provided by clients and ideas from the cake artist/business owner. Your cake/desserts will not look exactly like the photos as we do not duplicate cakes designed by other bakers and cakes that we have designed in the past. We prefer that our clients have unique cakes for their celebrations.

If requested, sketches are provided after the contract is fully executed and the deposit or full payment is received. All sketches provided are the property of August June Desserts. Our sketches are a basis for the cake idea and the final cake design may differ from the sketch.

Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You will agree to notify your guests of this risk and hold us harmless for allergic reactions. August June Desserts is not liable for any damage or harm which may come to the consumer. While every effort is made to ensure that there is no cross-contamination, we regret that we can make no guarantees about the safety of our products for those with food allergies.

August June Desserts is not responsible for supplying fresh flowers or cake toppers that are not included in the design of your cake. If you would like to have fresh flowers or cake toppers included on your cake, the cost will be incorporated in the final cost of your order.

You acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants.

We take your health and safety very seriously. Disco dust, luster dust, or glitter will not be used on dessert items to be consumed. These items are non-toxic but are not meant for human consumption. They may only be used on decorations that are to be removed prior to consumption. Only sanding sugar, edible pearls, or sparkle dust that is labeled “edible” will be used on the edible portions of the desserts.

Edible Images can occasionally be tricky to work with, especially in humid weather. The instructions provided with your order are meant only as a guide to provide some assistance. If your images are torn, ruined, or otherwise made unusable by your efforts at removing it, we will not issue a refund.

There will be a $50 late pick-up charge for all late pick-ups. The fee must be paid before your cake/desserts are released to you. If you are not able to pick up your cake/desserts within a reasonable time frame (30 minutes), they will be returned to our inventory for resale. No refunds will be provided.

August June Desserts is not responsible for any damage to the cake or desserts after pick-up/delivery, or set-up. It is recommended that all custom cakes that have 2 or more tiers are delivered by our team to ensure safe arrival at the event venue. If you or your representative(s) elect to pick-up and set-up the cake/desserts, you assume all liability and responsibility for the condition of the cake/desserts once they leave our possession. A delivery disclaimer will be signed by both parties upon dessert delivery/pick-up.

If we are available, a call-out fee will be charged if a customer picks up a cake and then requires assistance in set-up or repair due to damage done en route or set-up. The call out fee amount is determined by the type of repair needed and round-trip mileage required to repair the cake and will need to be paid prior to repair.

You are responsible for providing a secure table and environment for the cake(s)/desserts. Cakes are heavy and require a sturdy dessert stand, sturdy table, and optimal room temperature of 73 degrees or below. Cakes cannot be displayed in a space without air conditioning, and it’s not recommended that cakes/desserts remain outdoors due to heat and small pests (ants, flies, etc.).

All cake orders that are delivered must be set out at least 1 - 2 hours prior to your event. All cakes are refrigerated until delivery. If we deliver the cake and there is not a suitable place for set-up, we are not responsible if your cake is cold/frozen or melted at the time of cutting, as the cake was not stored properly upon delivery. Cake care and cake handling instructions are provided with your order.

You agree to assume full responsibility for your guests and agree to indemnify and hold August June Desserts harmless from and against all bodily injury, property damage or consequential damages which may result from August June Desserts' services and provision of your cake/desserts.

For safety purposes, do not smash cakes or cupcakes into anyone's face due to possible toppers/supports (wooden dowels) on top and within the dessert items. August June Desserts is not responsible for damage caused by such acts.

​We photograph all our cakes and desserts and reserve the right to use any photographs that we take for social media, and marketing/promotional use without consent or compensation from/to you.

August June Desserts will not be liable for any delay due to circumstance beyond our control such as transportation problems, delays in product delivery, inclement weather, acts of God, or other causes beyond August June Desserts control that make it impossible or impractical for August June Desserts to complete the cake/dessert order.

Force Majeure and Safe Environment In the event of a "natural disaster", nationwide/state of emergency, or an "Act of God", including a global epidemic (COVID-19), pandemic, or outbreak requiring a change of event date, due to a canceled or postponed event by you or the event coordinator, we will allow rescheduling within 1 year of the event date, based on our calendar availability. Refunds will be decided on a case-by-case basis if applicable. Deposits and the cost of supplies are not refundable; however, you will not have to pay a new retainer. There are no penalties or additional cost unless your order is changed. If your order is changed, all updates will reflect current pricing. If you have a balance due and it is paid by the due date, you are stating that you are continuing with the event on the scheduled date and no credit will be given.

If August June Desserts cannot perform or believes it may not be able to perform the work outlined in this contract in whole or in part due to a national or regional emergency, a "natural disaster", emergency, or "Act of God", including a global epidemic (COVID-19), pandemic, endemic, or other cause beyond the control of the parties or due to illness or injury, whether or not foreseeable, we will give notice to you as soon as possible. We will make reasonable efforts to suggest a replacement bakery for your event, will refund your payment, and shall have no further obligation to perform the work outlined in the contract.

August June Desserts works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, orders, and regulations. You understand and agree that we will not be required to perform the work in this contract if the event is held in violation of a Governmental Order or August June Desserts' participation in the event would violate a Governmental Order. August June Desserts is not obligated to continue to perform the work in this contract if the personal safety or well-being will be comprised or threatened at the event, including, but not limited to, the condition of the venue for the event, or the conduct of the event attendees.

CANCELLATION POLICY

All cancellations must be received in writing via e-mail.

In the event your event is canceled, all deposits and payments for your order are non-refundable and will NOT be issued under any circumstances.

If for any reason you need to postpone/reschedule your event, please contact August June Desserts immediately to review our calendar for availability.

If your event date is rescheduled, you can use your deposit/payment towards a future date, if it is available on our calendar. If that date is not available, your deposit/payment will not be refunded.

August June Desserts has every right to cancel your order. You will be informed in writing and your deposit will be refunded within 60 days of the cancellation.
